Warranty terms
PHATFOUR WARRANTY TERMS
Our warranty terms apply to all Phatfour products. Among other things, they set out how long the warranty period lasts and which parts are covered by the warranty.
ARTICLE 1 PHATFOUR WARRANTY
Maintenance determines the service life of every bike, including yours. Have a first inspection carried out after 300 km on the FLB+ and FLS+ / 250 km on the FLX, or within 3 months of purchasing your bike, in order to keep your warranty. Maintenance can also be carried out by our Phatfour mechanics or by an approved bicycle repair shop. Keep the receipts from the repair shop as proof of the maintenance performed.
ARTICLE 2 WARRANTY
- Phatfour warrants that Phatfour bikes are free from defects in construction and/or materials, in each case to the extent that follows from these warranty provisions.
- The warranty may only be invoked by the first owner of the Phatfour bike concerned.
- The warranty lapses in accordance with the provisions of articles 3.1 and 5.1.
- The warranty is not transferable.
- The warranty period starts on the day of delivery, after the delivery has been accepted and received.
ARTICLE 3 WARRANTY PERIOD
- Phatfour bike frames carry a warranty period of 2 years against defects in construction and/or materials.
- Phatfour bike mudguards carry a warranty period of 2 years against defects in construction and/or materials.
- All electrical parts carry a warranty period of 2 years against defects in construction and/or materials.
- Phatfour provides a 2-year warranty on the battery. Battery capacity will decrease in proportion to the number of charging cycles and its age. This decrease in capacity is not covered by the warranty.
- All other parts, with the exception of the parts referred to in article 2.7, carry a warranty period of 2 years against defects in construction and/or materials.
- All accessories carry a warranty period of 1 year against defects in construction and/or materials.
- No warranty is given on parts subject to wear, such as tyres, chain, chainrings, cables and brake pads, unless there is a defect in construction and/or materials.
- For Phatfour bike display models, 50% of the warranty periods stated above applies.
ARTICLE 4 WARRANTY EXCLUSIONS
-

a. The bike has not demonstrably (with invoice / receipt) received a first maintenance service after 3 months or 300 km following delivery.
b. The Phatfour has not demonstrably (with invoice / receipt) received an annual maintenance service after the first inspection was carried out.
c. Where the defects are the result of incorrect assembly, meaning assembly that deviates from the supplied assembly instructions, which can also be found on the website.
d. Incorrect and/or careless use of the Phatfour bike that is not in accordance with its intended purpose, including:
i. Riding up and down kerbs when fully loaded;
ii. Riding into kerbs;
iii. Technical repairs that have not been carried out professionally.
e. Parts fitted afterwards do not correspond to the technical specifications of the bike concerned or have been fitted incorrectly.
f. Where proof of ownership is not available.
g. Where it is established that the maximum speed of 25 km/h has been modified.
h. Where the saddle is loaded with more than 120 kg.
i. Where the luggage carrier is loaded with more than 25 kg.
j. In the event of damage caused by an accident or any other external calamity. -
Furthermore, any liability of Phatfour for damage to (parts of) the Phatfour bike is expressly excluded where it results from:
a. Incorrect adjustment/tension of the handlebars, stem, saddle, seat post, derailleur set, brakes, gears and/or parts working loose, the readjustment of wheels and spokes during use, as well as spoke breakage.
b. Failure to replace parts in good time, such as brake/derailleur cables, brake pads, tyres, chain and sprockets.
c. Climatic influences such as normal weathering of paint or chrome rust. This also applies to the saddle, which may change colour through use and/or external factors such as UV radiation, moisture and heat.
d. Climatic influences such as discolouration of paint and saddle.
e. Phatfour bikes used for rental purposes. - Modifications have been made to the original condition and settings, such as the use of parts and/or accessories not approved by Phatfour;
ARTICLE 5 LABOUR COSTS ON PARTS IN THE EVENT OF A WARRANTY CLAIM
- During the warranty period, all parts which Phatfour has established to have a defect in materials and/or construction will, at Phatfour's discretion, either be repaired or reimbursed. Any costs of (dis)assembly are for the owner's account where the owner may reasonably be expected to fit the replacement part themselves.
- By way of derogation from the previous paragraph, in the case of defects in materials and/or construction of frames and front forks, the labour costs are also for Phatfour's account for two years from the date of purchase.
ARTICLE 6 SUBMITTING A CLAIM UNDER THE WARRANTY
- Claims under this warranty must be submitted to Phatfour by email, stating the order number, frame number and including a photo of the part concerned. This allows Phatfour to assess whether the case is covered by the warranty.
- Phatfour will accept or reject the claim within a reasonable period. Should it not reasonably be possible to assess the defect without seeing the Phatfour bike in person, a suitable solution will be sought in consultation with the owner.
- Before sending a replacement product, Phatfour may require the product concerned to be sent to Phatfour first for assessment. On the basis of that assessment, Phatfour may decide that the product is not covered by the warranty terms, or send a replacement product.
- The costs of transporting the Phatfour bike and/or parts to and from Phatfour are for the owner's account.
- If a particular part qualifies for warranty and the original is no longer available, Phatfour will provide an at least equivalent alternative.
ARTICLE 7 LIABILITY
- A warranty claim honoured by Phatfour does not automatically mean that Phatfour also accepts liability for any damage suffered. Phatfour's liability never extends further than as described in these warranty terms and/or the applicable general terms and conditions of Phatfour.
